In North Carolina it is a criminal offense to operate a motorboat or motor vessel on the waters of this state while under the influence of an impairing substance (alcohol, drugs).  Like the charge of Driving While Impaired, a person is considered impaired by alcohol if he or she has an alcohol concentration of .08 or greater.
