 In recent years the Sentencing Guideline Commission has focused on the guideline provisions dealing with those convicted of so called “white collar crimes.” In doing so, changes to a number of key components have had the effect of substantially increasing the sentence that defendants convicted of such crimes will receive. Generally such crimes deal with money or some property of value.
As such, the amount of money involved, whether breaches of trust or of a fiduciary nature are presented by the facts and whether the prosecutor deems that the accused has engaged in an obstruction of justice have all become more important factors in considering the appropriate defense in this area of federal criminal practice.
