In general a person commits the crime of statutory rape if he or she has vaginal intercourse with a person who is 15 years old or younger, and the defendant is more than four years older than the child. The severity of a statutory rape charge varies based on the age of the victim and the age of the defendant.

  • Indecent Liberties with a Child: A person is guilty of taking indecent liberties with a child if the defendant is at least 16 years of age and for the purpose of arousing or gratifying sexual desire, willfully commits or attempts to commit a lewd or lascivious act upon the body of a child who is under the age of 16. The child must be at least five years younger than the defendant.

  • Solicitation of Child by Computer to Commit Unlawful Sex Act: In North Carolina a person is guilty of this offense if he or she is 16 years of age or older and knowingly with the intent to commit an unlawful sex act uses a computer to entice or coerce a child less than 16 of age to meet the person for the purpose of committing an unlawful sexual act.

  • Internet Sex Crimes: Prosecutions for internet related sex crimes are increasing in North Carolina. State law enforcement agencies have created special task forces for the purpose of investigating internet sex crimes. Generally, internet sex crimes involve the distribution of child pornography and the use of the internet to solicit minors for the purpose of committing an unlawful sexual act.
