With the real estate markets booming in the Charlotte region, construction projects are at an all time high. Contractual issues often arise in the context of commercial construction projects, residential construction projects or even in large scale residential renovation projects.

With respect to residential construction projects, it is important to know your rights whether you are a homeowner, a general contractor or a sub-contractor. Homeowners may have a construction laws, property lien, construction lawyerright of action against a general contractor if the project is not completed in a workmanlike manner or if the costs exceed the contract amount.

Similarly, a subcontractor may have lien rights if they do not receive payment for their services. The law imposes very strict deadlines on a subcontractor who wishes to lien funds or property. The unpaid subcontractor must typically take action within 90 or 120 days after the last day of services.

Property owners, general contractors and subcontractors often must enter into contracts in order for a project to be completed. This is often achieved by utilizing a uniform set of contracts which have been created by the AIA.
